What is the Scope of This Privacy Notice?

This United States Privacy Notice (“US Notice”) provides information about how Corteva Agriscience™ and its affiliates (“We”, “Us”, “Our”, or “Corteva”) collect, use, and disclose Personal Information of United States residents. This US Notice supplements the information contained in the Corteva Global Privacy Statement (“Privacy Statement”).  In the event of a conflict between the Privacy Statement and this US Notice, this US Notice will prevail. This US notice does not apply to Our employees or job applicants where the Personal Information We collect about those individuals relates to their current, former, or potential role with Us.

Sources of Personal Information

As used in this US Notice, “Personal Information” or “Personal Data” means information that is linked or reasonably linkable to an identified or identifiable individual. We may collect Personal Information from a variety of sources including:

  • From You, when You interact or communicate with Us, for example through Our online sites, applications, mobile apps, blogs, social media platforms, facilities, trade shows, or promotions.
  • Our retailers, distributors, and sales representatives.
  • Our third-party service providers and business partners such as those providing support for customer service, web hosting, marketing, communications, event planning, data analytics, and financial services.   
  • Publicly available databases.
  • Joint marketing partners and social media platforms when they share the information with Us.

Purposes for Collecting, Using, Selling, Sharing, and Disclosing Personal Information

We and Our service providers collect, use, sell, share, and disclose Personal Information for the following purposes:

Provide Our services and support Our customers

  • To maintain or service accounts, verify customer information, provide customer service, and respond to your inquiries, process, or to fulfill orders and transactions.
  • To provide financing, fulfillment services, process payments, collections, and risk management.
  • To send administrative information to You such as changes to Our terms, conditions, and policies, or warranty or recall information.

Marketing, promotions, and personalization

  • To send You marketing-related communications with information about Our services, new products, and other news about Corteva.
  • To offer You the opportunity to participate in sweepstakes, contests, or other promotions.
  • To develop and deliver marketing and other promotional communications tailored to your interests and to analyze or predict Our user’s preferences to prepare aggregated trend reports on how Our digital content is used so We can improve our services and offerings.

Legal and compliance

  • For legal and regulatory compliance, including uses and disclosures of Personal Information required by law or for compliance with company policies and procedures or with civil, criminal, judicial, or regulatory inquiries, investigations, subpoenas, or summons.
  • To exercise or defend the legal rights of Corteva and its officers, directors, employees, customers, contractors, and agents and for dispute resolution.

  • To protect the security and integrity of Our systems, networks, applications, and data, including detecting, analyzing, and resolving security threats, communicating with law enforcement and information security consortiums, debugging services or systems, identity management including verification and authentication for systems and technology.
  • For premises security, safety and loss prevention, detection and prevention of fraud and other illegal activity.

Does Corteva “Sell” Your Personal Information, “Share” It for Cross-Context Behavioral Advertising, or Use It for Targeted Advertising?

We do not sell your Personal Information for money. Some states define a “Sale” of Personal Information to include receipt of any benefit for the disclosure of Personal Information. We may be considered to “Sell” Personal Information, as that term is defined by some state laws, to send You marketing-related communications, analyze or predict your preferences, and prepare aggregated trend reports, for example. Under those state laws, Categories of Personal Information that We Sell and have Sold in the preceding 12 months include:

  • Internet or Other Electronic Network Activity (e.g., “cookies” or other tracking technologies)
  • Identifiers (e.g., name, postal address, email address, phone number)
  • Professional Information (e.g., company name, company postal address, e-mail address, phone number, name, and professional title)
  • Commercial Information (e.g., products or services purchased, purchase history)

We Sell, and have Sold within the preceding 12 months, the above categories of Personal Information to the following third parties:

  • Marketing, advertising, and data analytics partners

We may “Share” your Personal Information for “Cross-Context Behavioral Advertising,” as those terms are defined under California Law. Additionally, We engage in Targeted Advertising (as defined in the “Your Rights” section below), which does not require any disclosure of your Personal Information to a third party. Categories of Personal Information that We Share for Cross-Context Behavioral Advertising and that We have Shared for Cross-Context Behavioral Advertising in the preceding 12 months include:

  • Internet or Other Electronic Network Activity (e.g., “cookies” or other tracking technologies)
  • Identifiers (e.g., name, postal address, email address, phone number)
  • Professional Information (e.g., company name, company postal address, email address, phone number, name, and professional title)

We Share, and have Shared within the preceding 12 months, the above categories of Personal Information with the following third parties:

  • Marketing, advertising, and data analytics partners

We do not knowingly Sell the Personal Information of minors under the age of thirteen or knowingly Share such Personal Information for Cross-Context Behavioral Advertising.

Retention Period

We retain each category of Personal Information, including Sensitive Personal Information, for as long as needed or permitted in light of the purpose(s) for which it was collected.  The criteria used to determine Our retention periods include: 

  • The length of time We have an ongoing relationship with You and provide services to You (for example, for as long as You have an account with Us or keep using Our services) and the length of time thereafter during which We may have a legitimate need to reference your Personal Information to address issues that may arise;
  • Whether there is a legal obligation to which We are subject (for example, certain laws require Us to keep records of your transactions for a certain period of time before We can delete them); or
  • Whether retention is advisable in light of Our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

Your Rights

Residents of certain states have rights under the privacy laws of those states, subject to applicable exceptions or limitations. Corteva voluntarily extends these privacy rights to all US residents. Please see the provisions below for additional rights available to California residents. If You make a privacy request, We will maintain a record of your request and Our response to it.

Correction

You may request that your inaccurate Personal Information be corrected or updated, subject to certain exceptions. We may request documentation to determine the accuracy of the requested correction or update.

Access/Copy of Personal Information

You may ask Us to confirm whether We are processing Personal Information about You and request a copy of the specific pieces of Personal Information, subject to certain exceptions.

Deletion

You may request that We delete the Personal Information that We have about You, subject to certain exceptions. In some circumstances, in response to a deletion request We may choose to anonymize, aggregate, or deidentify your Personal Information so that it cannot be linked to or used to identify You.

Opt-Out of the Sale of Personal Information

You may opt-out of the Sale of Personal Information, as defined by state law.

Opt-out of Targeted Advertising

You may opt-out of Targeted Advertising. “Targeted Advertising” means the display of advertisements where the advertisement is selected based on Personal Information obtained from a person’s activities over time and across nonaffiliated websites or online applications. You may receive Targeted Advertising even when Corteva does not share any Personal Information about You. After opting out of Targeted Advertising, You still may see Corteva advertisements that are unrelated to Targeted Advertising.

Opt-out of Profiling

Corteva does not use automated technology to profile individuals in furtherance of decisions that have a legal or similarly significant effect on You.

Right Not to Be Subject to Discrimination

You have the right to be free from unlawful discriminatory treatment for exercising your rights under applicable privacy law.

If You are a California resident, You may request that We disclose to You the following information:

  1. the categories of Personal Information We have collected about you;
  2. the categories of sources from which your Personal Information was collected;
  3. the business or commercial purpose for which We collected, Sold, or Shared your Personal Information;

  5. the categories of third parties to whom We have Sold your Personal Information or Shared it for Cross-Context Behavioral Advertising and for each category identified, the categories of Personal Information Sold or Shared; and
  6. the categories of Personal Information that We have disclosed for a business or commercial purpose and for each category identified, the categories of third parties with whom We have disclosed that category of Personal Information.

Opt-Out of the Sale/Sharing of Personal Information for Cross Context Behavioral Advertising

Corteva recognizes Global Privacy Control (GPC) signals for California and Nevada residents to opt-out of Sale/Sharing for Cross-Context Behavioral Advertising. GPC is a technical specification for transmitting universal opt-out signals. You can enable GPC by installing a browser or extension that supports the signal.

While We recognize the GPC signal as a valid request to opt-out of Sale/Sharing for the particular browser or device transmitting the signal, We may not be able to relate the browser or device to You and therefore will not have enough information to opt You out of all Sale/Sharing. If You wish to opt-out of all Sale/Sharing including offline Sale/Sharing of Personal Information You should submit a privacy request. You may make such a request via the online Privacy Request Form available at privacyrequest.us.corteva.com.  If You do not have access to the Privacy Request Form You can call 1-800-686-6200 for assistance. 

Limit the Use or Disclosure of Sensitive Personal Information

California law provides individuals the right to limit the use or disclosure of Sensitive Personal Information for the purpose of inferring characteristics about an individual. Corteva does not collect, use, or disclose Sensitive Personal Information for such purpose.

California Shine the Light

You may opt-out from Our disclosure of your Personal Information to third parties for the third parties’ direct marketing purposes by submitting your request to Customer Information Center, Attn: California Privacy Request, 9330 Zionsville Rd., Indianapolis, IN 46268. Any such request must include in the first line of the description “California Privacy Shine the Light Request” and include your name, street address, city, state, and zip code.

Verification of Identity

To protect your Personal Information, your request to delete, correct, access, or to know, is subject to an identification and verification process. The information required for the verification process will depend on the nature of the request, and We may require additional information in order to respond to certain types of requests. Please promptly respond to any communication from Us so that We may process your request without delay. If You maintain a password-protected account with Us, We may verify your identity through Our existing authentication practices for your account and may require You to re-authenticate yourself before disclosing or deleting your Personal Information. Your request may be denied if We are unable to verify that You are the individual to whom the Personal Information relates.

Under certain state laws an authorized agent may make a request on your behalf. The ability to use an authorized agent varies by state and the type of privacy request. In order to protect your privacy and the security of your Personal Information, We may request that the agent provide information necessary to verify your identity and proof that the agent is authorized by You to act on your behalf.

Appeal

If We refuse to act on any part of your request, You may appeal Our decision within 45 days of receipt by contacting Us through the privacy request portal at privacyrequest.us.corteva.com or by calling 1-800-686-6200 if You do not have access to the privacy request portal.

Deidentified Information

Where We maintain or use de-identified data, We will continue to maintain and use the de-identified data only in a de-identified fashion and will not attempt to re-identify the data.
